pnbsp; How do you collect when you receive a bounced check in Israel?nbsp; Many a href=http://www.israelilawyer.net/ target=_blankIsraeli attorneys /a wonrsquo;t take clientsnbsp;like this because there is not enoungh money in the case.nbsp; So what can you an individualnbsp;do to collect on a bounced check?nbsp;nbsp; It can get messy, and if it does you should see an a href=http://www.israelilawyer.net/ target=_blankIsraeli Attorney/a but for most situations, and assuming that the maker of the checknbsp;doesnrsquo;t defend against it, this is what youd do/p
pnbsp;The first step that you should donbsp;is to go to person who gave you the check and try to get them to pay it.nbsp; If that doesnrsquo;t work then start collections via the collections court.nbsp; The collections courts are located at most courts of the peace, and there is at least one in every major cirty.nbsp;/p
pYou have check in hand and must fill out form 801.nbsp; You must attach the original check and a photo copy of both sides.nbsp;/p
pnbsp;You pay the filing fee which is the larger of 1.25% of the debtnbsp;or a statutory minimum which changes from time to time (get the most recent rate at 02-6593333).nbsp; Remember ndash; all the fees that you end up paying in the collections process will be paid by the maker of the check when you finally collect.nbsp;/p
pnbsp;A warning letternbsp; will be sent out by the collections court to the check maker.nbsp; It should be served within 21 days.nbsp; You should call in every few days to make sure that itnbsp;was served (i.e. received by the check writer).nbsp; If it isnrsquo;tnbsp;then after 3 weeks you can attempt to do it yourself by using a process server./p
pnbsp;Now you try to start taking their assets.nbsp; If you believe that the person has money but just doesnrsquo;t want to pay, or if you know of another bank where they have an account, obviously those are the easiest places to start to try to collect on.nbsp; In any case, you use form 841 and choose how you want to try to collect.nbsp; The same form is used for each place you will try to collect against ndash; employers, placing a lien against and later forcing the sale of cars or real estate, placing an order preventing the person from leaving Israel etc.nbsp; You have to pay the statutory fee when filing, and there are some time limitations to follow ndash; for example you canrsquo;t try to sell real estate to cover the check unless the lien has been listed for at least 30 days (i.e. which was done by the form 841)/p
pnbsp;Once you have submitted the form 841 then within 30 days the collections court shouldnbsp; get answer from the bank (as to whether or not there is money in an account) and then you may have to fill the formnbsp; 841 again – but now thenbsp; collections court would get the money from the bank, and it will then issue the funds they collect back to you.nbsp;/p
pnbsp;Congratulations – you have now collected on the bad check./p
